Introduction: This code of conduct outlines the expected behaviour, responsibilities, and professional standards for all driving instructors (Instructors) associated with Smart Licence Pty Ltd's booking platform (Platform). It applies to all interactions with learner drivers (Learners) sourced through the Platform, both during use of the Platform and all subsequent bookings and interactions.

1. Professional Conduct

  1. Respect and Dignity: Instructors must treat all Learners with respect, dignity, and professionalism at all times.
  2. Punctuality: Instructors must be punctual for all bookings and notify Learners promptly if there is any delay or rescheduling (can be done by portal as well).
  3. Language and Communication: Instructors must use appropriate language and communicate effectively with Learners. Offensive, discriminatory, or abusive language is strictly prohibited.
  4. Appearance and Vehicle Maintenance: Instructors must maintain a neat and professional appearance and ensure that their vehicles are clean, roadworthy, and appropriately equipped.

2. Safety and Compliance

  1. Safety First: Safety is the top priority. Instructors must adhere to all traffic laws and regulations, ensuring a safe learning environment for Learners.
  2. Licenses and Certifications: Instructors must hold a valid driving instructor license and any other required certifications. These must be kept up to date at all times.
  3. Drug and Alcohol Policy: Instructors must not be under the influence of drugs or alcohol while providing instruction or interacting with Learners.
  4. Health and Wellness: Instructors must not conduct lessons if they are unwell or unfit to drive.

3. Privacy and Confidentiality

  1. Confidentiality: Instructors must respect the privacy of Learners and keep all personal information confidential. This information must not be shared with third parties without explicit consent.
  2. Data Security: Instructors must take appropriate measures to ensure the security of Learners' personal data, both on the Platform and during interactions.

4. Ethical Practices

  1. Fair Treatment: Instructors must not discriminate against Learners based on age, gender, ethnicity, religion, sexual orientation, or disability.
  2. Honesty and Integrity: Instructors must act with honesty and integrity in all interactions with Learners and the Platform.
  3. Conflict of Interest: Instructors must disclose any potential conflicts of interest to Smart Licence Pty Ltd.

5. Harassment

  1. Driving instructors are prohibited from engaging in any behaviour on the Platform that could be construed as harassment of any kind, including sexual harassment of individuals.
  2. Unreasonable behaviour that puts the health and safety of another person at danger is referred to as harassment. It comprises actions that degrade, threaten, or offend a worker in their place of employment. It can be direct or indirect. Violence, threats of injury, and public humiliation are a few instances of this.
  3. Sexual harassment refers to any behaviour in which an individual: initiates an unwanted sexual approach; requests an unwanted sexual Favor; or engages in other unwanted sexual behaviour toward another individual in situations where a reasonable person would have expected the other individual to be offended, humiliated, or intimidated. This implies that sexual harassment can happen even when the aggressor has no intention of offending, dehumanizing, or intimidating the victim.
  4. The actions listed below are instances of behaviour that could qualify as sexual harassment:

·      physical contact (e.g., touching);

·      gazing or gesturing;

·      phone calls;

·      social invites;

·      inquiries unrelated to business;

·      sexual remarks, jokes, queries, or taunting; and/or the presence of explicit material in emails or texts.

  1. We also have a policy of "no relations on the job." When giving driving instruction, it is reasonable to need to contact a learner physically. However, make sure you get their express agreement beforehand.


6. Use of the Platform

  1. Adherence to Platform Guidelines: Instructors must use the Platform in accordance with its terms and guidelines.
  2. No Unauthorized Use: Instructors must not use the Platform for unauthorized purposes or engage in any behaviour that could harm the Platform's reputation or operation.
  3. Feedback and Reviews: Instructors must encourage constructive feedback from Learners and respond to reviews appropriately, without engaging in retaliatory or defensive behaviour.


7. Reporting and Accountability

  1. Reporting Misconduct: Instructors must report any observed misconduct or breaches of this code to Smart Licence Pty Ltd.
  2. Cooperation with Investigations: Instructors must cooperate fully with any investigations conducted by Smart Licence Pty Ltd regarding breaches of this code.
  3. Consequences of Breaches: Breaches of this code may result in disciplinary action, including suspension or termination of the instructor’s account on the Platform.

8. Continuous Improvement

  1. Training and Development: Instructors are encouraged to pursue ongoing training and professional development to improve their skills and knowledge.
  2. Feedback and Adaptation: Instructors should seek and respond to feedback from Learners and Smart Licence Pty Ltd to continuously improve their conduct and teaching methods.

By using the Platform and providing driving instruction services to Learners sourced through the Platform, Instructors agree to abide by this Code of Conduct and understand that failure to comply may result in disciplinary action by Smart Licence Pty Ltd.
